Such written permission must also be obtained before any part of the publication is stored in a retrieval system of any nature.

For A-Z Data-on-Disc, Tomorrow’s Guides Ltd supplies the Licensee with care home data extracted from its A-Z Care Home database and licenses the Licensee for the following uses of care home data supplied for the agreed time period:

- For storage within the Licensee's own computer system.

- For unlimited use within the Licensee's own business-to-business direct mail applications.

- For extraction of statistics, reports for use within the Licensee's own organization and by the Licensee's own employees.

Any extension or variation of the above uses must be with Tomorrow's Guides' prior written permission. The care home data supplied to the Licensee may not be sold to, transmitted to or used by any third party, nor may it be included on an Internet site. Where applicable, it is the responsibility of the Licensee to screen telephone/fax numbers against the Telephone/Facsimile Preference Service Registers and other relevant regulatory authorities.

CONTENT

We reserve the right to refuse any application for inclusion on this website www.carehome.co.uk or in the A-Z Care Home Guides. We have the sole right to remove any content. Please do not submit any content that contains pornographic, gambling, racist, sexist or hate material.

The following applies to the content of advertisements (including banner adverts), inserts, logo listings, bold listings and enhanced listings:

- Advertisements/inserts are accepted upon the representation that the advertiser and its agency have the right to publish the contents.

- All contents of advertisements/inserts are subject to Tomorrow’s Guides Ltd approval. Tomorrow’s Guides Ltd reserves the right to reject or cancel any advertisement, insertion order, space reservation, or position commitment at any time.

- Positioning of advertisements, inserts and listings is at the discretion of Tomorrow’s Guides Ltd except where a specific request for a position is acknowledged by Tomorrow’s Guides Ltd in writing.

- Coupons in advertisements are not acceptable.

EXCLUSION OF LIABILITY

Although all reasonable care has been taken in the compilation of www.carehome.co.uk, the A-Z Care Homes Guide and A-Z Data-on-Disc, Tomorrow's Guides Ltd cannot accept any liability for any consequences arising from the use of the information contained within these products. We are not an agent and accept no responsibility or liability for the users direct dealings with care homes or suppliers featured on our publications.

We accept no liability for data or advertisements supplied for inclusion on www.carehome.co.uk, the A-Z Care Homes Guide and A-Z Data-on-Disc. The supplier of data or the advertisement is responsible for ensuring it is accurate, complete, updated when necessary and for ensuring that it is not untrue, threatening, defamatory, pornographic, obscene, abusive, objectionable or in breach of any applicable laws or rights of third parties. Advertisements and data are accepted upon the representation that the supplier has the right to publish the contents. In condition of such publication, the supplier agrees to indemnify Tomorrow’s Guides Ltd against any loss or expense by reason of any claims arising out of its publication.

Tomorrow’s Guides Ltd is not liable for delays in delivery of the A-Z Care Homes Guide in the event of any condition occurring beyond the control of the Publisher affecting production or delivery in any manner.

Tomorrow’s Guides Ltd shall not be liable for any cost or damages if for any reason it fails to publish an advertisement, insert, bold, logo or enhanced listing in the A-Z Care Homes Guide or on www.carehome.co.uk.

Tomorrow’s Guides Ltd have no responsibility or liability for the information, such as credit card number and contact information, that are provided directly to Netbanx the operators of the online banking payments system, during the purchase transaction.

PAYMENT / CANCELLATION

Standard payment terms are 30 days net from date of invoice. For A-Z Data on Disc, payment and the signing of the license agreement is required before the data is supplied.

Advertisements and bold/logo/enhanced listings are generally invoiced on publication. However, if there has been an early booking discount available and it has been taken up, the invoice data can be before publication.

Once an order for a book, advert, listing or data has been received the order is non-cancellable and non-refundable.

Any use of the Care Homes data supplied after the expiry date of this Licence will automatically incur an additional year’s Licence fee at the current renewal rate for the data supplied.

Tomorrow’s Guides Ltd shall have the right to hold advertiser and/or its agency jointly and severally liable for money that is owed for advertising, whether it was ordered by either the advertiser or its agent.

PRIVACY POLICY

Tomorrow’s Guides Ltd uses all reasonable endeavours to ensure the security of systems on which personal data is stored and may be processed.

If you make a purchase on www.carehome.co.uk, the financial information you provide such as credit card number is not stored by Tomorrow’s Guides Ltd but is provided directly to Netbanx the operators of the online banking payments system. Tomorrow’s Guides Ltd have no responsibility for the privacy policies of the Netbanx.

Tomorrow’s Guides Ltd used cookies as a means of offering and providing customisable and personalised services on www.carehome.co.uk. However, the user browser has settings that will allow the user to accept all cookies, be informed as cookies arrive or reject all cookies. The downside of rejecting all cookies is that we are then unable to match the site content we offer you to what we know about your preferences from your previous visits.

Tomorrow’s Guides Ltd may contact listed companies by email, telephone, fax or by post with information about its products. Tomorrow’s Guides Ltd may also pass these details to other companies or organisations operating within the industry. It is company policy not to pass on personal email addresses or email addresses that have been specifically provided to us for the delivery of marketing reports. If you wish to be excluded, please email info@carehome.co.uk and your entry will be removed.
